Terms of Service

This is a translation of the Russian original. In case of any discrepancy between the two versions, the Russian version prevails.

1. Parties and Subject Matter

This document is a public offer by Individual Entrepreneur MAKSIM GUSEV (hereinafter — the "Rightholder"), addressed to any legally capable adult individual (hereinafter — the "User"), to enter into an agreement on the use of the Between Bubbles service on the terms set out below.

The service is the Between Bubbles web application: a personal wine tasting diary available at winesdiary.com and app.winesdiary.com. The service is intended for personal, non-commercial use: keeping track of what the User has tasted and of their own impressions.

2. Conclusion of the Agreement

The agreement is considered concluded at the moment the User, during registration, ticks the consent checkbox for these terms and the privacy policy and creates an account. The service records the date of consent and the document version in effect at that moment. No separate signing on paper is required.

3. Age Restriction

The service is available only to individuals who have reached 18 years of age. The date of birth is requested during registration; providing false information is grounds for immediate account suspension. Excessive alcohol consumption is harmful to your health. The service does not provide medical advice, does not encourage consumption, and is not an advertisement for alcoholic beverages.

4. License Grant (What the User Receives)

The Rightholder grants the User a personal, worldwide, non-exclusive, non-transferable, and revocable license to use the service for its intended purpose: to keep tasting entries, store photos, maintain a personal wine directory, view weekly metrics and statistics, export their data, and publish individual entries via a link. This license is not transferable to third parties.

The service is currently provided free of charge. The set of features may change and expand. If paid features appear, their terms will be published in advance as a separate document; the export of data already created remains available in any case.

The following actions are strictly prohibited: interfering with the operation of the service, bypassing rate limits, collecting data by automated means (scraping), attempting to gain unauthorized access to other users' diaries, probing security vulnerabilities without the Rightholder's written permission, and using the service for unlawful purposes or to promote alcoholic beverages.

9. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. The Rightholder explicitly disclaims all warranties, whether express or implied, including fitness for a particular purpose. The Rightholder does not guarantee uninterrupted operation or the absence of errors: scheduled maintenance, updates, and outages caused by providers are possible. Database backups are made regularly; nevertheless, the User is strongly advised to keep their own export — it is available in the settings in CSV and JSON formats at any time.

10. Limitation of Liability

The service is a personal record-keeping tool, not medical, dietary, or other professional advice. Decisions about alcohol consumption are made by the User independently and at their own responsibility. To the maximum extent permitted by applicable law, the Rightholder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of the use of or inability to use the service.

A new version is published on this page with an updated date and version number. The Rightholder notifies Users of material changes at the email address provided during registration and, where necessary, requests consent again. Continued use of the service after a new version takes effect constitutes agreement with it.

13. Governing Law and Disputes

This agreement is governed by the laws of Georgia. The parties resolve disputes by correspondence: a request is sent to [email protected], with a response time of 30 days. Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Georgia at the location of the Rightholder.
